Our House Rules

Etsy’s Share & Save Terms ("Programme Terms")

By participating in the Etsy Share & Save Programme (the “Programme”), you agree to the below terms and conditions governing your participation in the Programme.

Thank you for joining Etsy’s Share & Save Programme (the “Programme”). The Programme allows you to obtain a refund of a portion of your Etsy Transaction Fees, as defined in Etsy’s Fees & Payments Policy, on Qualifying Transactions, defined below, that originate from unique shop and listings URLs provided by Etsy (the “URLs”) you share off of Etsy on Authorised Channels and in accordance with these Programme Terms. You can opt out of the Programme at any time on the Programme landing page. The Programme is void where prohibited.

You acknowledge and agree that your participation in the Programme is subject to these Programme Terms, all of Etsy’s House Rules, including but not limited to the Etsy Terms of Use (including the limitation on warranties in Section 8, indemnification provisions of Section 9, and arbitration provisions in Section 11) and Etsy’s Privacy Policy (collectively, the “Terms”). All of the Terms are incorporated by reference and you should understand them and know you are bound to them by participating in the Programme. Please make sure you read and understand these policies, as you cannot participate in the Programme or may be removed from the Programme if your use of Etsy’s services is not in compliance with any of the Terms, or presents a risk to Etsy, its users or its partners, as determined by Etsy in its sole discretion.

Please note that Section 11 of Etsy’s Terms of Use contains a binding arbitration agreement and class action waiver for users in North and South America. By agreeing to these Share & Save Programme Terms, you and Etsy agree to submit any disputes between us exclusively to individual arbitration and not to sue in court, except in the limited circumstances described in Etsy's Terms of Use (including if you have exercised your limited right to opt out).

These Programme Terms may be modified at any time pursuant to Section 12 of the Terms of Use.

The Programme

Etsy’s Share & Save Programme offers eligible sellers the opportunity to obtain a refund of four (4) percent of the Qualifying Transaction Total from your transaction fees (the “Refund”). The Qualifying Transaction Total is the price you display for each listing plus the amount you charge for postage and gift wrapping. The Refund applies only to Qualifying Transactions that originate from the URLs and is subject to these Programme Terms. If you are an Etsy Payments user and you list your items in a currency other than your payment account currency, see the Currency Conversion section in the Etsy Fees & Payments Policy for more details on the transaction fee. As outlined in the Etsy Fees & Payments Policy, if you offer optional personalisation for an additional fee, the additional fee for personalisation is added to the listing price you display and the total display price is subject to the same transaction fees described in this Section. You will see the Refund in your Payment Account applied as a discount to the Etsy Transaction Fees to each Qualifying Transaction.

Due to tax laws in some jurisdictions, the Refund could be considered a supply of a service from you to Etsy. The Refund applied to your account from a Qualifying Transaction is inclusive of any withholding taxes or taxes you may be required to apply or charge to Etsy. Except for the limited circumstances outlined in Section 5 (Taxes) of the Etsy Fees & Payments Policy, you are responsible for any taxes that may be due as a result of the sales you make on Etsy. Depending on where you are located, Etsy may or may not apply VAT or any similar tax to the Refund issued to you.

The URLs

You will be provided with unique link types, each a “URL” and together the “URLs”.

  • Unique shop URL: On your Shop Manager and Etsy Seller App dashboards, you’ll find a unique link that brings buyers to your Shop Home page.
  • Unique listing URL: In your Listings Manager or listings tab in the Etsy Seller App, you can copy a unique link for each listing in your shop if you want to bring buyers directly to a specific item.
  • Unique shop section URL: When viewing your shop section(s) in the Etsy Seller App, you’ll find a unique link that brings buyers to a shop section.

When your shop makes a Qualifying Transaction that results from your sharing the URLs on Authorised Channels, as defined below, you may receive a Refund on such Qualifying Transactions. “Authorised Channels” means your owned and operated social media pages, websites, blogs, emails, and such other communications, media and channels that have been accepted and approved by Etsy for participation in the Programme. URLs may not be shared or linked on the Etsy platforms, including the Etsy mobile apps. Transactions concluded via URLs shared or linked anywhere other than on Authorised Channels or on any Etsy platforms will not qualify for a Refund under the Programme.

You must comply with any applicable local marketing and consent laws when sharing your URL(s). When posting URLs, it is your responsibility to follow and abide by each third party platform’s terms and conditions, including any policies on including third party links.

Qualifying Transactions

If a buyer clicks on your URL(s) from an Authorised Channel and completes a purchase from your shop within thirty (30) days of clicking that URL, you will receive a Refund on that transaction (each, a “Qualifying Transaction”) subject to the exclusions in these Programme Terms. The following exclusions apply:

  • For sellers opted-in to Etsy Offsite Ads, if within the thirty (30) day attribution window, after clicking the URL, the buyer later visits and completes the purchase from your shop via an Etsy Offsite Ad, the transaction is not a Qualifying Transaction and you may be charged the Offsite Ads fee for that transaction.
  • Transactions concluded via URLs shared or linked on the Etsy platform or anywhere other than on Authorised Channels are not considered Qualifying Transactions.
  • If you participate in Etsy’s Affiliate Programme or Creator Co, then you may not also participate in the Etsy Share & Save Programme.
  • You will not receive a refund or credit or any other consideration for linking to other seller’s shops or listings under this Programme.
  • You will not receive a Refund if you make a purchase from your own shop and then ask for a refund of the purchase.
  • If a buyer is granted a refund of the Qualifying Transaction, you will not receive a Refund on those transactions.

Paid Search

In connection with the Programme, you agree that you will not bid on any keywords containing Etsy trademarks for internet search advertising, search engine optimisation, or for any other purpose. You may not purchase domain names that have variations from Etsy’s domain or misspellings in them which are solely intended to direct traffic away from the Etsy Site, or purchase any domains containing Etsy Trademarks, including variations or misspellings. You must comply with the following conditions, including in connection with any advertising on any ad platform (e.g. search engines, content networks, and social networking sites):

  • You are not permitted to bid or appear on searches, including extended or hybrid searches, that include the term (including misspellings or variations) “Etsy”
  • You are not permitted to use Etsy’s trademarks in any paid search activity, including ad text, copy or display URLs;
  • You are not permitted to direct link PPC activity to Etsy.com; this includes using Etsy.com as a display URL;
  • You are not permitted to send traffic through automatic redirects on a website page;
  • You are not permitted to use the Etsy name (including misspellings and variations) as a sub-domain or sub-folder;
  • You are not permitted to use Etsy trademarks, or any variation thereof, in hidden text or source code, including within its site’s domain or sub-domain;
  • You are not permitted to use Etsy's brand in a manner that suggests an affiliation, association, or brand partnership, or in a manner otherwise inconsistent with Etsy's Trademark Policy; and
  • You are not permitted to engineer your site in such a manner that it pulls internet traffic away from the Etsy Site, including without limitation, "keyword stuffing" such as using terms in hidden or live text that is meant to attract search engine spiders in order to determine higher relevance or rank than the Etsy Site.

Compliance with Laws; Responsibility for Your Authorised Channels

As laid out in Etsy’s Terms, you are also responsible for ensuring that your use of Etsy’s services, and your website and services comply with all applicable laws and regulations applicable in your jurisdiction. If you violate any of Etsy’s policies, you may lose your ability to use Etsy’s services, and Etsy reserves the right to take any necessary actions to protect its rights and services.

Depending on where you are located, you may be subject to varying regulations relating to the operation, marketing, and advertising of your site or your pages or content on the Authorised Channels, as applicable. It’s your responsibility to know and follow any applicable regulations that apply to your site and content. Etsy is unable to provide legal advice; we urge you to speak to a legal expert if you are unsure of your obligations or have specific questions.

You must comply with all applicable international, federal, state, and local laws as it relates to operation of your website, if applicable, and/or your posting of content on the Authorised Channels and any organic or paid advertising of your website. You are solely responsible for your site and/or content that you post on the Authorised Channels and data you collect from the Authorised Channels, if any.

You must ensure all of your email marketing complies with applicable laws and regulations, including without limitation, the Controlling the Assault of Non-Solicited Pornography and Marketing Act of 2003 (the “CAN-SPAM Act”), Canada’s anti-spam legislation or “CASL”, the European Directive 2002/58/EC (Directive on privacy and electronic communications) and any local law implementations of such directive including for the UK, the Privacy and Electronic Communications (EC Directive) Regulations 2003 (“PECR”) and any other applicable anti-spam or related regulations, laws, or industry best practices, related to the dissemination of commercial emails in their country. Emails must not state or imply that the email is being sent by, or on behalf of, Etsy, or Etsy sellers. Again, Etsy is unable to provide legal advice; we urge you to speak to a legal expert if you are unsure of your obligations or have specific questions.

Etsy is not liable for any content or information on your Authorised Channels or for any of your users’ claims relating to your Authorised Channels, and you agree to defend, indemnify, and hold Etsy harmless from and against all claims relating to your site and the content of your social media pages or other Authorised Channels. You agree that you will comply with the following requirements with respect to your website, advertising for your website, and social media presence:

  • Ensure all URLs are up to date with what is offered on Etsy;
  • Ensure the accuracy and appropriateness of materials and content posted on your site;
  • Ensure that materials and content posted on your site are not libellous or unlawful, and do not violate or infringe upon the rights of any third party (including, but not limited to, copyrights, trademarks, privacy or other personal or proprietary rights);
  • Ensure that your site complies with all applicable national, state, regional and local laws and regulations, including any codes of practice applicable to your marketing and displaying content on your website, and that your website clearly and conspicuously displays a website terms of use and privacy policy (“Legal Notices”).

General Terms

Confidential Information; Feedback You understand that as part of your participation in the Programme you may be exposed to Etsy features or information that is not, and may never become, available to the public such as, by way of example only, beta features ("Confidential Information"). Confidential Information does not include information that is generally known about Etsy, information that you have legally obtained from sources other than Etsy or persons with confidentiality obligations to Etsy, or information that is or becomes available to the public through no act that violates these programme terms. You agree to keep confidential and secret all Confidential Information. In other words, you agree you will not disclose Confidential Information with anyone, including but not limited to other Etsy members. Etsy considers a breach of confidentiality to be a material violation of Etsy’s Terms of Use.

We appreciate receiving your feedback about the Programme (“Feedback”). You grant Etsy the right to use the Feedback (legally, it’s an irrevocable, perpetual, worldwide and royalty-free licence to use any of the Feedback as permitted by law - but this doesn’t mean Etsy owns it, just that we can use it). We need these rights to improve the Programme based on your and others’ feedback, and make related products and services, including those of our partners, even better.

Right to Audit; Suspension & Termination

Etsy has the right but not the obligation to audit you, your sites or content on the Authorised Channels, including compliance with the Programme Terms, in relation to your participation in the Programme. If Etsy believes that you have breached these Programme Terms or that you have engaged in fraudulent activity, it may take any steps it deems appropriate, such as: (i) issue a warning; (ii) conduct an investigation; (iii) suspend your account; (iv) terminate your account from participation in the Programme; or (v) withhold Refunds.

Additional Representations and Warranties In addition to any applicable representations and warranties in the Terms, you represent and warrant that (a) you have the authority to participate in the Programme and enter into these Programme Terms, (b) you will, in the performance of all of your rights and obligations under these Programme Terms, comply with all applicable laws, rules, and regulations and codes of practice, (c) any material or communication which is displayed or used by you in connection with the Programme will not (i) infringe on any third party’s copyright, patent, trademark, trade secret, or other proprietary rights or right of publicity or privacy; (ii) be defamatory or libellous; (iii) be lewd, pornographic, or obscene; (iv) violate any laws, including those regarding unfair competition, antidiscrimination, consumer financial protection or false advertising; (v) promote violence or contain hate speech; (vi) promote discrimination, based on race, age, sex, religion, nationality, sexual orientation, gender expression or disability; or (vii) contain viruses, trojan horses, worms, time bombs, cancelbots, or other similarly harmful or deleterious programming routines.

No Partnership You further understand that your participation in this Programme does not create any partnership or ongoing vendor commercial relationship between you and Etsy. You may not represent yourself as an Etsy partner (except as approved by Etsy in writing), or use the Etsy name or logos in any manner inconsistent with Etsy’s Trademark Policy.

Miscellaneous Etsy may modify, suspend or cancel the Programme at any time for any or no reason. Any exceptions to these Programme Terms are effective only if expressly made in writing by Etsy. Etsy is not responsible for errors in any Programme related materials, or any errors or delays in the processing of any Refunds you may be entitled to. Etsy reserves the right to change or modify the terms and conditions contained in these Programme Terms, at any time. Any changes or modifications to these Programme Terms will be effective upon posting of the revisions. By continuing to participate in the Programme after such time, you will be deemed to have accepted such changes. These Programme Terms supersede any other agreement between you and Etsy regarding the Programme including any prior version or beta/prototype. If any part of these Programme Terms are found to be invalid or unenforceable, that part will be limited to the minimum extent necessary and severed so that the Programme Terms will otherwise remain in full force and effect. Our failure to enforce any part of the Programme Terms is not a waiver of our right to later enforce that or any other part of the Programme Terms. We may assign any of our rights and obligations under the Programme Terms.
