Last updated: 24 February 2025
This Privacy Policy explains how CMZARTS ("we", "us", "our"), collects, uses, and protects personal information when you purchase an item, contact us, or otherwise use our services through Etsy.com or its related sites and services. By using our services or making a purchase, you acknowledge that you have read and understood this policy and agree to its terms. If you do not agree, you should leave CMZARTS immediately.
We may update this Privacy Policy from time to time. If any changes are made, we will update the date above to reflect this.
Information We Collect:
To process and fulfil your orders, we collect certain personal information, including your name, email address, postal address, payment details, and details of the products ordered. You may also choose to provide us with additional personal information (for example a personal photo), if you contact us directly.
For personalised artwork, we store personal photos when provided by you. These, along with postage labels, are securely stored on our Microsoft OneDrive account.
How We Use Your Information:
We collect and use your personal information for the following purposes:
To fulfil and manage your orders, including processing payments, dispatching items, and providing customer support.
To comply with legal and regulatory obligations, such as retaining purchase records for tax purposes.
To communicate with you regarding your orders, updates, or any issues relating to our services.
Sharing Your Information:
Your personal information is treated with the highest level of confidentiality. We only share it in limited circumstances, including:
Etsy. We share information with Etsy as necessary to provide you our services and comply with our obligations under both the Etsy Seller Policy and Etsy Terms of Use.
Service providers: We use trusted third-party companies to fulfil certain business functions, and provide services to our shop, such as delivery companies. Your information is shared only to the extent necessary for these services.
Legal compliance: We may collect, use, retain, and share your information if we have a good faith belief that it is reasonably necessary to: (a) respond to legal process or to government requests; (b) enforce our agreements, terms and policies; (c) prevent, investigate, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of our customers, or others.
Business transfers: If we sell or merge the business, your personal data may be included as part of the transaction, in accordance with applicable laws.
Data Storage and Retention:
We retain your personal information only for as long as necessary to fulfil your orders and to comply with legal and regulatory requirements. Typically, we keep records for five (5) years. After this period, data is securely deleted unless it is required for ongoing legal or operational purposes.
International Data Transfers:
We may store and process your information through third-party hosting services in the US and other jurisdictions. As a result, we may transfer your personal information to a jurisdiction with different data protection and government surveillance laws than your jurisdiction. If we are deemed to transfer information about you outside of the EU, we rely on the Data Privacy Framework (DPF) as the legal basis for the transfer, as Microsoft OneDrive complies with the EU-U.S. Data Privacy Framework.
Your Rights:
If you reside in certain territories, including the EU, you have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in certain limited cases. Your rights are as follows:
Right to Access. You may have the right to access and receive a copy of the personal information we hold about you by contacting us using the contact information below.
Right to Change, Restrict, or Delete. You may also have rights to change, restrict our use of, or delete your personal information. Absent exceptional circumstances (such as where we are required to store information for legal reasons) we will generally delete your personal information upon your request.
Right to Object. You can object to (a) our processing of some of your information based on our legitimate interests and (b) receiving marketing messages from us. In such cases, we will delete your personal information unless we have compelling and legitimate grounds to continue storing and using your information or if it is needed for legal reasons.
Right to Complain. If you reside in the EU and wish to raise a concern about our use of your information (and without prejudice to any other rights you may have), you have the right to do so with your local data protection authority.
