Right of Withdrawal for the Sale of Goods
Right of Withdrawal for Consumers
(A consumer is any natural person who enters into a transaction for purposes that are predominantly outside their trade, business, or profession.)
Withdrawal Instructions
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us (Projektsued GmbH, Klausnerring 17, 85551 Kirchheim b. München, Email: shop@projektsued.de) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You may use the attached model withdrawal form, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery charges (except for additional costs arising if you selected a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the date we receive notice of your withdrawal from this contract. We will use the same means of payment as you used for the initial transaction, unless otherwise agreed; in no case will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the goods back or you have provided evidence of having sent back the goods, whichever is earlier.
You shall send back the goods to us without undue delay and, in any event, no later than 14 days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send back the goods before the period of 14 days has expired.
You bear the direct costs of returning the goods.

General Terms and Conditions and Customer Information / Privacy Policy
I. General Terms and Conditions
§ 1 Basic Provisions
These terms apply to contracts you enter with us as the provider (Projektsued GmbH/Susan Riedel) via the Etsy platform. Any terms you may use are excluded unless expressly agreed upon.
§ 2 Conclusion of Contract
(1) The subject of the contract is the sale of goods.
(2) When we list an item on Etsy, the release of the offer page on Etsy constitutes a binding offer to conclude a contract under the conditions contained in the item description.
(3) The purchase contract is concluded via the online shopping cart system as follows: The goods intended for purchase are placed in the "shopping cart." You can access the "shopping cart" at any time via the corresponding button in the navigation bar and make changes there. After selecting the payment method and proceeding to the "Checkout" or "Pay with PayPal" page, you enter your personal and payment-related data. Finally, all order details are displayed on the order summary page.
If you use an instant payment system (e.g., PayPal or Sofortüberweisung), you will first be directed to the provider's website of the instant payment system. Upon completion, you will be returned to the Etsy order summary page.
Before submitting the order, you have the opportunity to review, change (also via the "back" function of the internet browser), or cancel the purchase on the order summary page. By submitting the order via the respective button, you declare your legally binding acceptance of the offer, thus concluding the purchase contract.
(4) Order processing and transmission of all information required in connection with the conclusion of the contract are handled via email, some of which are automated. Therefore, you must ensure that the email address you have provided to us is accurate, and that you are able to receive emails and that they are not blocked by spam filters.
§ 3 Custom-Made Products
(1) You shall provide us with the appropriate information, text, or files necessary for the individual design of the goods via the online ordering system or by email at the latest immediately after the conclusion of the contract. Any format requirements we may have must be observed.
(2) You agree not to transmit any data that infringes third-party rights (especially copyrights, name rights, trademark rights) or violates existing laws. You expressly release us from any claims asserted by third parties in this regard. This also includes the costs of the necessary legal defense.
(3) We do not review the transmitted data for accuracy and are not liable for any errors.
(4) Where specified in the respective item description, we will send you a correction template, which you must promptly review. If you agree with the draft, you must approve the correction template by signing in text form (e.g., by email). Design work will not proceed without your approval. You are responsible for reviewing the correction template for accuracy and completeness and for notifying us of any errors. We assume no liability for unreported errors.
§ 4 Right of Retention, Retention of Title
(1) You may only exercise a right of retention if it concerns claims from the same contractual relationship.
(2) The goods remain our property until the purchase price has been paid in full.
§ 5 Warranty
(1) Statutory warranty rights apply.
(2) As a consumer, you are requested to check the goods immediately upon delivery for completeness, obvious defects, and transport damage, and to promptly notify us and the carrier of any complaints. Failure to do so does not affect your statutory warranty rights.
§ 6 Choice of Law
(1) German law applies. For consumers, this choice of law only applies to the extent that it does not deprive them of the protection provided by mandatory provisions of the law of the country in which they have their habitual residence (favorable principle).
(2) The provisions of the UN Convention on Contracts for the International Sale of Goods expressly do not apply.

Information on the Conclusion of the Contract

3.2. The complete contract text is not stored by us. Before submitting the order, you can print or save the contract data electronically using your browser’s print function. After receiving the order, we will email you the order details, legally required information for distance contracts, and the General Terms and Conditions.

Prices and Payment Terms
5.1. The prices stated in each offer, as well as the shipping costs, are total prices. They include all price components, including all applicable taxes.
5.2. Shipping costs are not included in the purchase price. They can be accessed via a corresponding button on our website or in the respective offer, are itemized during the order process, and are to be borne by you unless free shipping is confirmed.
5.3. For deliveries to countries outside the European Union, additional costs may arise that we are not responsible for, such as customs duties, taxes, or money transfer fees (bank transfer or exchange rate fees), which you must bear.
5.4. In cases where the delivery is to an EU member state but payment is made outside the European Union, you are responsible for any money transfer fees incurred (bank transfer or exchange rate fees).

5.6. Unless otherwise specified for individual payment methods, payment claims from the contract are due for immediate payment.
Delivery Terms
6.1. The delivery terms, delivery date, and any existing delivery restrictions can be found under a corresponding button on our website or in the respective offer.
Unless otherwise stated in the respective offer or under the corresponding button, the goods will be delivered within 3-5 days after the conclusion of the contract (in the case of agreed prepayment, only after receipt of your payment instruction).
6.2. If you are a consumer, it is legally stipulated that the risk of accidental loss and accidental deterioration of the sold item during shipment is transferred to you only upon delivery of the goods, regardless of whether the shipment is insured or uninsured. This does not apply if you independently commission a transport company not named by the entrepreneur or a person otherwise designated to carry out the shipment.

Unless otherwise specified below, the provision of your personal data is neither legally nor contractually required, nor necessary for the conclusion of a contract. You are not obliged to provide your data. Failure to provide it will have no consequences. This only applies insofar as no other indication is made in the subsequent processing operations. Collection, Processing, and Transfer of Personal Data in Orders
When you place an order, we collect and process your personal data only to the extent necessary to fulfill and process your order and to handle your inquiries. The provision of data is necessary for the conclusion of the contract. Failure to provide it means that a contract cannot be concluded. Processing is based on Art. 6(1)(b) GDPR and is required to fulfill a contract with you.
Your data is transferred, for example, to the shipping companies and dropshipping providers you select, payment service providers, service providers for order processing, and IT service providers. In all cases, we strictly adhere to legal requirements. The scope of data transmission is limited to a minimum.
Inventory Management
Use of an External Inventory Management System

Storage Duration
After the contract has been fully processed, the data is initially stored for the duration of the warranty period, then in accordance with statutory retention periods, particularly those related to tax and commercial law, and is deleted after these periods expire unless you have consented to further processing and use.
