The same company also trades as CraftMint on Vinted. That shop has its own privacy policy, published on Vinted, and this policy does not cover it.
This policy describes how and when we collect, use, and share information when you purchase an item from us, contact us, or otherwise use our services through Etsy.
Etsy is a separate data controller for its own processing. It runs the marketplace, the checkout, the payment system and the messaging system, and it holds far more information about you than we do, including your payment details, which we never see. This policy does not cover Etsy's practices. You can reference the Etsy Privacy Policy to learn about them.
2. What We Actually Hold
We are a controller only for the limited information Etsy passes to us, or that you send us directly. In practice that is:
- your name and the delivery address needed to post your order, as printed on the postage label;
- your email address, where Etsy provides it;
- the order details - what you bought, when, and for how much;
- the content of any messages you send us through Etsy or by email, including any photographs you choose to send us to show a problem with an item;
- anything additional you choose to give us for a custom order.
We do not receive or store your card or bank details. Payment is processed by Etsy and its payment providers.
3. Why We Need Your Information and How We Use It
We rely on a number of legal bases to collect, use, and share your information, including:
As needed to provide our services, such as fulfilling your order, arranging returns and refunds, settling disputes, and providing customer support.
When you have provided your affirmative consent, which you may revoke at any time, such as by signing up for our mailing list.
If necessary to comply with a legal obligation, court order, or in connection with a legal claim, such as retaining information about your purchases if required by tax law.
As necessary for our legitimate interests, if those legitimate interests are not overridden by your rights or interests, such as providing and improving our services, our instructions and our packaging, and preventing fraud.
4. Information Sharing and Disclosure
We share your personal information for very limited reasons and in limited circumstances, as follows:
Etsy: we share information with Etsy as necessary to provide you our services and comply with our obligations under both the Etsy Seller Policy and Etsy Terms of Use.
Service Providers: we engage certain trusted third parties to perform functions and provide services to our shop, such as delivery companies, our accountant, and the everyday business software we use to keep records and correspondence. We share your personal information with these third parties only to the extent necessary to perform these services.
Compliance with Laws: we may collect, use, retain, and share your information if we have a good faith belief that it is reasonably necessary to respond to legal process or government requests, to meet our tax and accounting obligations, to enforce our agreements and policies, to prevent fraud and illegal activity, or to protect the rights and safety of our customers.
We do not sell your personal information, and we do not send marketing messages without your consent.
5. Data Retention
We retain your personal information only for as long as necessary to provide you with our services and as described in this Privacy Policy. We keep order and transaction records for six years after the end of the relevant financial year, in order to meet UK tax and accounting requirements. Messages and enquiry records are kept for as long as is necessary to deal with your query and any related claim, and are then deleted.
6. Where Your Information Is Held, and Transfers Outside the UK
We keep records and correspondence using standard business software and cloud services. Some of these providers, and some of our other service providers, may store or process information outside the United Kingdom. As a result, your personal information may be transferred to a jurisdiction with different data protection laws than yours.
Where information is transferred outside the UK, we rely on UK adequacy regulations where they apply, and otherwise on the UK International Data Transfer Agreement, or the UK International Data Transfer Addendum to the EU Standard Contractual Clauses, together with appropriate safeguards.
7. Your Rights
You have a number of rights in relation to your personal information. While some of these rights apply generally, certain rights apply only in specific cases. These rights include:
Access: you have the right to access and receive a copy of the personal information we hold about you by contacting us.
Change, Restrict, Delete: you may also have rights to change, restrict our use of, or delete your personal information. Absent exceptional circumstances (such as where we are required to store data for legal reasons), we will generally delete your personal information upon request.
Object: you can object to our processing of some of your information based on our legitimate interests, and to receiving marketing messages from us after providing your express consent to receive them. In such cases, we will delete your personal information unless we have compelling and legitimate grounds to continue using that information.
Portability: you can ask us to provide certain information you have given us in a portable format.
Complain: if you wish to raise a concern about our use of your information (without prejudice to any other rights you may have), you have the right to do so with the UK Information Commissioner's Office (ICO), Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF, ico.org.uk, telephone 0303 123 1113. If you live in the EU, you may instead complain to your local data protection authority.
We will respond to any request to exercise these rights within one month.
8. Information Held by Etsy Rather Than Us
If you want to access, correct or delete personal information held by Etsy rather than by us - for example your account details, your payment information, or your full message history - we will direct you to Etsy at Etsy.com/help, because that data is under Etsy's control, not ours.
