Terms and Conditions for Digital Products

By purchasing, downloading, or using any digital product (including but not limited to patterns, designs, images, papers, seamless patterns, and other digital creations) from [Violet and Meadow], you agree to the following Terms and Conditions. These terms govern the use of the Seller’s digital products, and any violation of these terms may result in legal action or termination of access to the Seller’s products.
1. License Grant
Upon purchase, the Buyer is granted a non-exclusive, non-transferable, and non-sublicensable license to use the digital product(s) for personal use and small commercial use for finished physical items only. Commercial use is strictly limited to the application of the digital product(s) on finished, tangible products such as printed items, packaging, or physical goods. The digital products may not be used for digital products, digital files, or in any digital format for resale, distribution, or sharing without prior consent from the Seller.
2. Restrictions on Use
The following actions are strictly prohibited without explicit written permission from the Seller:
-No Redistribution: The Buyer may not redistribute, share, or transfer the digital products to any third party, whether for free or for compensation.
-No Mass Production: The Buyer may not use the digital products in mass production, including, but not limited to, printing, publishing, or producing large quantities of products without prior consent from the Seller.
-No Resale: The Buyer may not resell, license, sublicense, or offer the digital products for resale, either in their original form or modified form, in part or whole.
-No Use on Print-on-Demand (POD) Platforms: The Buyer is prohibited from using the digital products for print-on-demand services (POD), including but not limited to platforms such as Printify, Spoonflower, Amazon Merch, Printful, or any other mass POD services. The digital products may not be uploaded, printed, or sold through these services.
ALLOWED: for Small Home-Based Fabric Printing Shops Only: The digital products may only be used in small, in-home based fabric printing shops where the business operates with two employees or fewer (a "mom and pop" shop). Mass production or distribution through any commercial services is strictly prohibited.
No Sharing with Others: The Buyer is prohibited from sharing the digital product files (including but not limited to PNG, JPG, PSD, or other image files) with any other individuals, businesses, or organizations.
No Posting in Dump Groups: The Buyer may not post or share the digital products in any similar online forums, including but not limited to social media groups, messaging platforms, or online marketplaces.
No Modification for Redistribution: The Buyer may not modify or alter the digital products in any way for the purpose of resale, distribution, or sharing. This includes, but is not limited to, extracting elements, creating new designs, or packaging files for resale.
No Inappropriate Use: The Buyer may not use the digital products in any manner that is illegal, offensive, harmful, discriminatory, defamatory, or otherwise disrespectful. The digital products must not be used in any content that promotes harm, hate speech, violence, or illegal activities.
3. Intellectual Property Rights
The Seller retains full ownership
The Buyer acknowledges that they do not acquire any rights to the underlying intellectual property of the digital products beyond the granted usage rights specified in these Terms and Conditions.
4. Prohibited Platforms
The digital products may not be uploaded, shared, or distributed on any file-sharing platforms, online marketplaces, or public sites, including but not limited to sites such as Google Drive, Dropbox, WeTransfer, or similar platforms.
The Buyer may not engage in any activity that allows for the mass sharing, distribution, or duplication of the digital products through any digital channels, whether public or private.
5. Enforcement and Remedies
The Seller reserves the right to take legal action against any violations of these terms, including seeking monetary damages and injunctive relief. Violations of these terms may result in the immediate termination of the Buyer’s access to the digital products, as well as other legal actions as appropriate.
In the event of a breach of these Terms and Conditions, the Buyer agrees to indemnify, defend, and hold harmless the Seller from and against any and all claims, losses, damages, liabilities, and expenses (including legal fees) arising out of or related to the violation.
6. No Refunds
Due to the digital nature of the products, the Seller does not offer refunds for any purchased items. All sales are final. The Buyer is responsible for ensuring the digital products are suitable for their intended use before making a purchase.
7. Modifications to Terms
The Seller reserves the right to modify or update these Terms and Conditions at any time without prior notice. Changes will be posted on this page, and the revised terms will take effect immediately upon posting. It is the Buyer’s responsibility to regularly review these terms for updates.
